The use of print materials in the classroom by instructors and graduate students is covered by the University's Access Copyright license, as well as the Supreme Court of Canada's 2004 Law Society of Upper Canada v. CCH decision

Over the last few years, there has been a significant increase in the instructional use of digital materials. Faculty members use WebCT and JUMP as part of their course delivery, post material on UM server-based course or department Web sites, and upload electronic reserve materials. Graduate students need to clear copyright for their thesis or dissertation.

Faculty and students are responsible for ensuring that those materials do not infringe copyright. The copyright issues related to these uses are often, however, the source of confusion and misunderstanding.

Keep in mind that:

  • Material on the Web is protected by copyright.
  • The Access Copyright license does not cover digital copying and distribution.
  • Digital rights are protected by the Canadian Copyright Act.
  • Uploading materials on a password-protected website infringes copyright.
