Conditions of Use for Data Library Services

at the University of Manitoba Libraries

Statistics Canada (Data Liberation Initiative)

• The Government of Canada is the owner, or the licensee, of the intellectual property rights (including copyright) in the data products offered under the Data Liberation Initiative, and this licence is only a licence to use these data products. No title or other rights are conveyed by this licence.
• These data products are provided 'as is', and the owner makes no representations or warranties, either expressed or implied, as to the appropriateness and fitness for a particular purpose.
• The data products are to be used only by educators, students and other staff members of this educational institution (referred to herein as "authorized users") and only while they have such status with this educational institution.
• These data products are provided for the exclusive purposes of teaching, academic research and publishing, and/or planning of educational services within this educational institution, and may not be used for any other purposes without the explicit written approval, in advance, of Statistics Canada.
• Authorized users are prohibited from using these data products in the pursuit of any commercial or income-generating venture either privately, or under the auspices of the educational institution.
• Authorized users shall not attempt to re-identify the records on the microdata files so as to relate the particulars to any individual person, business or organization.
• Copies of the data products can be retained by authorized users for the period necessary to conduct the research or teaching, including their use as evidence of research methodologies and results, and subsequent research and analysis.
• The distribution of any data obtained under this agreement outside this educational institution through sale, donation, transfer or exchange of any portion of these data in any way is strictly prohibited, with the exception of distribution to bona fide participants in the Data Liberation Initiative. The DLI Contact must agree to such distribution.
• The publishing of data and analysis resulting from research using any of these data products is permitted in research communications such as scholarly papers, journals and the like. The authors of these communications are required to cite Statistics Canada as the source of the data, and to indicate that the results or views expressed are those of the author/authorized user.

Inter-University Consortium for Political and Social Research (ICPSR): Benefits and Obligations of Membership

1. The ICPSR staff will endeavor to provide equitable services to each member. Given the variety of functions, the limitations on time and space in the performance of some activities, and the variable pace of research activities at member institutions, the goal shall be equality in service over a period of years.
2. Members will not distribute data or other materials supplied by ICPSR to other members, organizations, or individuals at other institutions, without the written agreement of ICPSR.
3. Member institutions agree that data and other material provided by ICPSR are to be used solely for statistical analysis and reporting of aggregated information, and not for investigation of specific individuals or organizations, except when identification is authorized in writing by ICPSR. Each member institution gives assurance that such uses of statistical data will conform to widely-accepted standards of practice and legal restrictions that are intended to protect the confidentiality of research subjects.
4. Books, articles, conference papers, theses, dissertations, and other publications or reports that employ data or other resources provided by ICPSR should cite both original data collectors and ICPSR as the source, in accord with recommended citation procedures for computer files in the social sciences.
5. Individuals who collect data or develop other research or instructional resources of general interest to the social science community are invited to make such resources available to the membership by offering them for deposit with ICPSR.
6. Member institutions, through their Official Representatives, have the right to express concerns and complaints about services to the Executive Director, and if a matter is not satisfactorily resolved to file a grievance with Council. Council will investigate grievances and take such action as may be appropriate.
